Terms & Conditions

(Pyarelal & Associates – Real Estate Brokerage Services)

These Terms & Conditions (“Terms”) govern the use of services provided by Pyarelal & Associates (“the Broker”). By engaging with our services, you (“the Client”) acknowledge and agree to abide by the following terms:


1. Scope of Services

1.1 The Broker acts solely as an intermediary between the Client and property developers, promoters, landowners, or third parties (“the Principal”).
1.2 The Broker does not own, construct, or sell property directly.
1.3 Services include property introductions, advisory support, and facilitation of communication between Clients and Principals.


2. Client Responsibilities

2.1 The Client agrees to provide accurate information regarding requirements, budget, and preferences.
2.2 The Client is responsible for conducting independent due diligence, including verification of property ownership, approvals, and legal compliance.
2.3 The Client acknowledges that all transactions are undertaken at their own discretion and risk.


3. Fees & Payments

3.1 Brokerage fees or commissions shall be payable to the Broker as mutually agreed in writing or verbally confirmed prior to finalization of the deal.
3.2 Such fees are non-refundable and shall remain payable even in the event of cancellation, withdrawal, or modification of the transaction by the Client or Principal.
3.3 Payments are to be made as per the agreed timeline; delays may attract interest or legal recovery action.


4. Limitation of Liability

4.1 The Broker shall not be held liable for:

  • Construction delays, cancellations, or changes by the developer.
  • Title disputes, regulatory non-compliance, or absence of approvals.
  • Quality of construction, amenities, or project delivery.

4.2 The Client agrees not to hold the Broker responsible for any loss, damage, or claims arising out of acts or omissions of the Principal.


5. Confidentiality & Privacy

5.1 Client information shared with the Broker shall remain confidential and used only for professional purposes.
5.2 The Broker will not be liable for any misuse or unauthorized disclosure by third parties beyond its control.


6. Third-Party Relations

6.1 Any commitments, assurances, or representations made by the Principal are outside the control of the Broker.
6.2 The Broker does not guarantee or endorse the performance, financial stability, or delivery capacity of any Principal.


7. Termination of Services

7.1 Either party may terminate the engagement with written notice.
7.2 Brokerage fees already earned or payable prior to termination shall remain due.


8. Indemnity

8.1 The Client agrees to indemnify and hold harmless the Broker against any claim, demand, or proceeding arising from acts, omissions, or disputes involving the Principal.
8.2 This indemnity survives the termination of services.


9. Governing Law & Jurisdiction

9.1 These Terms shall be governed in accordance with the laws of India.
9.2 Any disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996.
9.3 Courts located in [Your City/State] shall have exclusive jurisdiction.


10. Acknowledgment

By engaging with Pyarelal & Associates, the Client confirms understanding of these Terms & Conditions and agrees that the Broker functions solely as a facilitator without assuming responsibility for legal, construction, or financial risks of the property transaction.
